Seasonal Festive Lighting Rental Terms & Conditions
These terms apply to seasonal festive-lighting rental services supplied by We Hang Up Lights. They are intended to clearly define the rental period, ownership, installation, maintenance, takedown, access and customer responsibilities.
1. When the Rental Agreement Becomes Binding
A request for a free quote does not create a rental agreement and does not obligate the customer to proceed.
Unless otherwise expressly agreed in writing, a seasonal rental agreement becomes binding only after all of the following have occurred:
- The customer has received and reviewed the final custom quote and these Seasonal Festive Lighting Rental Terms & Conditions.
- The customer has expressly accepted the final quote and these Terms & Conditions.
- The required prepayment has been received by We Hang Up Lights.
- We Hang Up Lights has issued written confirmation that the seasonal rental booking is accepted and confirmed.
If payment is received but We Hang Up Lights cannot accept or confirm the booking, the payment will be returned in accordance with applicable law and the stated refund/cancellation terms.
3. Seasonal Rental Period
The rental covers one agreed seasonal display period for the property and lighting scope shown in the approved quote.
- Unless otherwise agreed in writing, the rental period begins when installation is completed and may not exceed 120 consecutive days.
- The customer must provide both a requested installation date and a requested takedown date.
- Requested dates are not guaranteed. Final installation and takedown dates or service windows are confirmed by We Hang Up Lights and may be affected by weather, scheduling, access and project requirements.
- Leaving the rental lighting installed beyond the confirmed rental period requires prior written approval and may be subject to additional rental and service charges.
- Extended-season or year-round lighting requires a separate written quote or agreement.
3. Ownership of Rental Equipment
All rental lighting, wire, bulbs, clips, timers, controllers, extension components and other equipment supplied as part of the rental service remain the property of We Hang Up Lights unless a separate written purchase agreement states otherwise.
The customer may not sell, transfer, dispose of, permanently alter, remove or retain rental equipment after the agreed rental period without written authorization from We Hang Up Lights.
4. Installation and Takedown Access
The customer agrees to provide reasonable and safe access to the agreed work areas for installation, service and takedown.
- The customer normally does not need to be home if exterior work areas, required power and access are available.
- Locked gates, unsecured pets, vehicles, construction, snow/ice hazards or other obstacles may require rescheduling.
- The customer must make the rental equipment available for removal on the confirmed takedown date or service window.
- Delays caused by denied or unavailable access may result in additional rental, service, recovery or rescheduling charges.
5. In-Season Maintenance — What Is Included
Standard in-season maintenance applies to common operating issues within the rental display installed by We Hang Up Lights, including:
- Individual rental bulbs that stop lighting.
- Loose connections within our installed rental lighting system.
- Sections of the installed rental display that stop operating and require normal service attention.
- Minor adjustments reasonably required to keep our installed rental display operating as intended.
6. In-Season Maintenance — What Is Not Included
Standard in-season maintenance does not include damage, faults or changes caused by circumstances outside normal operation of our installed rental system, including:
- Severe weather, storms, falling branches, heavy snow or ice events.
- Animals, vandalism, theft, tampering or accidental impact.
- Homeowners, tenants, contractors, landscapers or other third parties.
- Problems with the property's outlets, breakers, GFCIs, wiring, electrical service, power supply or other equipment outside our installed rental system.
- Customer-requested additions, relocations, colour changes or design changes after installation.
Service outside standard in-season maintenance may require a separate service charge or quotation.
7. Property Electrical Supply
The customer is responsible for providing suitable, functioning electrical power at the property. Electrical faults or deficiencies within the property are not part of the rental lighting maintenance service and may need to be corrected by the property owner or a qualified electrical professional.
8. Timers
If a timer is requested, the customer may provide preferred on/off times or choose to set the timer themselves. Timer settings may need to be adjusted after power interruptions, daylight-saving changes or other site conditions.
9. Colours, Design and Scope Changes
The approved quote is based on the agreed lighting areas, colour selection, pattern and installation design. Changes requested after approval or installation may be quoted separately. Standard colours are subject to availability, and specialty lighting may carry additional charges.
10. Commercial and High-Access Projects
Commercial properties and installations requiring boom lifts, specialty access equipment, permits or unusual site requirements are custom quoted. Equipment rental, permits and other site-specific requirements may be charged separately unless expressly included in the approved quote.
11. Pricing and Payment
Requesting a quote does not require payment. Once the customer approves the final custom quote, the required prepayment confirms the agreed seasonal rental installation, subject to these Terms & Conditions and the approved quote.
Normal remote-measurement variance within the agreed design is included in the approved quote. Additional areas, customer-requested scope changes or conditions materially different from the quoted scope may require additional pricing.
12. Returning-Customer Savings
Where offered, a 20% returning-customer discount applies to qualifying renewals based on the then-current regular seasonal rental service price for the same property and a substantially similar lighting scope. Material changes in design, access, additional areas, specialty lighting, equipment or permits may be quoted separately.
13. Failure to Allow Removal / Unreturned Equipment
If the customer prevents, refuses or unreasonably delays removal of rental equipment after the confirmed rental period, We Hang Up Lights may charge reasonable additional rental, service, rescheduling or recovery costs.
If rental equipment is lost, disposed of, retained, destroyed or cannot reasonably be recovered because of the customer's actions or failure to provide access, the customer may be responsible for the reasonable replacement value of the affected rental equipment and reasonable recovery-related costs.
Payment of replacement or recovery charges does not automatically convert the rental equipment into a customer purchase unless We Hang Up Lights expressly agrees to a sale in writing.
14. Customer Responsibility for Property Conditions
The customer is responsible for disclosing known access restrictions, unsafe conditions, construction, pets, restricted areas, electrical concerns or other conditions that may materially affect safe installation, service or takedown.
15. Relationship Between Quote and Terms
The accepted final quote identifies the specific customer/property, design, scope, price, service dates or windows and any project-specific conditions. These Terms & Conditions and the accepted final quote together form the seasonal rental agreement once the agreement becomes binding under Section 1. If a project-specific written term in the accepted final quote expressly differs from these general terms, the project-specific written term will apply to that issue, subject to applicable law.
